1) Eligibility
- You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Services.
- If you use the Services on behalf of another person (e.g., as parent/guardian/caregiver), you represent you are authorized to do so.
2) No Medical Emergencies / Medical Disclaimer
In an emergency, call 911 (or your local emergency number) immediately. Content on our Services is provided for informational and educational purposes only and is not a substitute for professional medical advice, diagnosis, or treatment.
3) Accounts & Authentication
- You agree to provide accurate, current, and complete information and to keep it updated.
- You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account.
- We may suspend/terminate your account for suspected fraud, misuse, or violation of these Terms.
4) Acceptable Use & Prohibited Conduct
- No unauthorized access, vulnerability scanning, or interference with the Services or related networks.
- No malware, scraping at scale, reverse engineering (except where permitted by law), or circumventing security controls.
- No illegal, infringing, harassing, hateful, or misleading content or conduct.
5) Third-Party Services (CRM, VoIP, EMR)
We integrate with third-party service providers to operate and improve the Services, including:
- CRM platforms for customer relationship management and communications.
- VoIP providers for inbound/outbound calling and messaging.
- Electronic Medical Records via Address Electronic Medical Records (a third-party provider) for record storage and administration.
- Document administration and marketing platforms (including advertising and social media).
Each third party may apply its own terms and privacy policies. We are not responsible for third-party failures, outages, or acts/omissions.
6) Payments, Subscriptions & Refunds
- Pricing and billing terms will be presented at checkout or enrollment. Taxes may apply.
- Subscriptions (if offered) renew automatically unless canceled per the instructions provided.
- Except where required by law, payments are final and non-refundable once services are rendered or access is granted.
- Chargebacks for valid charges may result in suspension of access.
7) Intellectual Property
The Services, including all content, design, trademarks, and software, are owned by Stamyna, LLC (“Stamyna”) or its licensors and are protected by law. You may not copy, adapt, or distribute our IP without prior written permission.
8) User Content & Feedback
- You retain ownership of content you submit but grant us a worldwide, royalty-free license to host, store, reproduce, and display it to provide the Services.
- Feedback is voluntary and may be used by us without restriction or compensation.
9) Disclaimers & No Warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING FITNESS FOR A PARTICULAR PURPOSE, MERCHANTABILITY, OR NON-INFRINGEMENT.
10) Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, Stamyna, LLC (“Stamyna”) AND ITS AFFILIATES (INCLUDING Alquimedez Mental Health Counseling, PLLC) WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY OR USD $100, WHICHEVER IS GREATER.
11) Indemnification
You agree to defend, indemnify, and hold harmless Stamyna, LLC (“Stamyna”), its officers, directors, employees, agents, and affiliates from any claims, damages, liabilities, and expenses arising from your use of the Services or violation of these Terms.
12) Governing Law; Disputes; Arbitration
- These Terms are governed by the laws of State of New York, USA, without regard to conflicts of law.
- Binding Arbitration & Class Action Waiver: Any dispute shall be resolved by individual, binding arbitration under the rules of the [Arbitration Body, e.g., AAA]. You waive the right to a jury trial and to participate in a class action.
- Opt-out right: You may opt out of arbitration within 30 days of first accepting these Terms by emailing info@stamyna.com with subject “Arbitration Opt-Out.”
13) Changes to the Services or Terms
We may modify these Terms at any time. Material changes will be posted with a new “Last Updated” date. Continued use after changes constitutes acceptance.

- Severability; entire agreement; no waiver by failure to enforce.
